The aim of this report is, from outside, without any preconceived
side-taking whatsoever, to determine whether or not there is a crime of
apartheid against the Palestinian people. While it is indeed true that
the international community decided to classify the crime of apartheid
in the wake of what was happening in South Africa, now the original
cause of its classification – the segregationist and racist South
African regime – is history, the persecution of this crime is still
underway, whether it be through the Convention on the Crime of
Apartheid, the Rome Statute of the International Criminal Court or
customary international law. Article 7 of the Statute of the
International Criminal Court defines the crime of apartheid as
“inhumane acts committed in the context of an institutionalised regime
of systematic oppression and domination by one racial group over any
other racial group or groups and committed with the intention of
maintaining that regime”. Taking this latest definition available as a
reference, which includes all jurisprudence and customary
international law on this matter, this report shall attempt to
determine, also in accordance with the Convention on the Crime of
Apartheid, whether the Palestinian people are enduring a comparable
situation and political stance.
