French Appeals Court Confirms Jurisdiction over Alstom Case

[La version franí§aise suit] AFPS, 22 December 2009 — The Court of Appeal of Versailles confirms the jurisdiction of the Tribunal of Nanterre regarding the legal claim brought by AFPS against Véolia transport, Alstom and Alstom transport regarding the construction and operation of a light railway in East Jerusalem.

Following the admissibility ruling handed down on the 15th of April 2009 by the High Court of Nanterre, accepting jurisdiction over the claims commenced by AFPS against Véolia Transport,
Alstom et Alstom Transport (see AFPS press release of the 2nd of December 2009), The Alstom et Alstom Transport companies contested this ruling in front of the Court of Appeal of Versailles by asking for the invalidation of the ruling of the Court of Nanterre.

The court of Appeal of Versailles handed down its ruling on the 17th of December 2009. The decision follows the line of arguments of our lawyers and satisfies us. The Court of Appeal of Versailles confirms the ruling of the High Court Nanterre regarding its jurisdiction on the case.

Thus, the case should come back the the High Court of Nanterre which will judge at last the substance of the case as soon as possible.

AFPS will publicize further useful information on the continuation of the proceedings.

La Cour d’appel de Versailles confirme la compétence du tribunal de Nanterre concernant la procédure engagée par l’AFPS contre Véolia Transport, Alstom et Alstom Transport concernant la construction et l’exploitation d’un tramway en Cisjordanie.

A la suite du jugement rendu le 15 avril 2009 par le Tribunal de Grande Instance de Nanterre qui s”est déclaré matériellement et territorialement compétent pour examiner les demandes de l”AFPS í  l”encontre des sociétés Véolia Transport, Alstom et Alstom Transport (voir communiqué du 2 décembre 2009) les sociétés Alstom et Alstom

Transport ont formé un contredit pour solliciter de la Cour d”appel de Versailles l”infirmation du jugement de Nanterre.

La Cour d”appel de Versailles a rendu sa décision le 17 décembre dernier.

L”arríªt, reprenant en grande partie l”argumentation de nos Avocats, nous donne satisfaction, la Cour d”appel confirmant le jugement en ce qu”il s”est déclaré compétent pour statuer sur le litige.

De ce fait, le dossier devrait revenir devant le Tribunal de Grande Instance de Nanterre dans les
semaines í  venir pour qu”enfin le fond du dossier soit jugé dans les meilleurs délais.

L”AFPS ne manquera pas de donner toutes informations utiles sur la suite de la procédure.
